Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BWin Consulting client portal and related services (the "Service"). The Service includes the BWin Consulting app and portal — Project Oversight, Technical Reports (PDF access), and Direct Contact (chat with engineers). BWin Consulting is the trading name of BWin Consulting v/Bjarne Winstrøm-Olsen, a Danish engineering and technical advisory firm (technical audit and project management, activity code 71.12.90) since 2014. The Service is owned and operated by BWin Consulting v/Bjarne Winstrøm-Olsen. By logging in or using the client portal, you agree to these Terms. If you do not agree, you must not use the Service.

1. Owner and Operator

The BWin Consulting client portal and the Service are owned and operated by BWin Consulting v/Bjarne Winstrøm-Olsen, Tandrupvej 7, 2665 Vallensbæk Strand, Denmark, CVR 36218991. The portal is developed by BWin Consulting tech. References to "we," "us," or "our" in these Terms refer to BWin Consulting v/Bjarne Winstrøm-Olsen.

2. Description of the Service

BWin Consulting provides a B2B client portal: Project Oversight (monitoring of engineering projects), Technical Reports (secure access to PDF reports and audits), and Direct Contact (communication with our engineers and consultants). We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice where practicable.

3. Acceptable Use

You agree to use the BWin Consulting client portal only for lawful business purposes and in accordance with these Terms. You must not use the portal to violate any applicable law, infringe the rights of others, or attempt to reverse engineer or misuse the service or its infrastructure. We may suspend or terminate your access if we reasonably believe you have breached these Terms.

4. Intellectual Property

All rights in the BWin Consulting portal, including the name, design, content, reports, and technology, are owned by BWin Consulting v/Bjarne Winstrøm-Olsen or its licensors. You may not copy, modify, distribute, or create derivative works from the portal or its content without our express written consent.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." BWIN CONSULTING V/BJARNE WINSTRØM-OLSEN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE PORTAL WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BWIN CONSULTING V/BJARNE WINSTRØM-OLSEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR 100 EUR, WHICHEVER IS LOWER, EXCEPT WHERE MANDATORY LAW REQUIRES OTHERWISE.

7. Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to them or the Service shall be governed by and construed in accordance with the laws of Denmark. Any legal action or proceeding shall be brought exclusively in the courts of Denmark.

8. Changes and Contact

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last Updated" date. Your continued use of the BWin Consulting client portal after such changes constitutes acceptance of the updated Terms.
